Thinking Creatively about Civil Commitment Defense

Marisol Orihuela, J.D. and Cassie Hazelip, J.D.

Workshop

Date: Thursday, 9/24

Time: 4-5:15pm

Far too often civil commitment proceedings are decided in what are called summary proceedings. While the proceedings are intended to be timely determined, summary proceedings should not be summary justice. This workshop will focus on helping think about what can be done to provide zealous representation when defending such cases. The hope is to promote the vigorous use of procedural and substantive protections through discussing and considering lawyering skills necessary to defend against involuntary commitments. We hope to include an approach to think about civil commitment defense, and some of the steps to consider, e.g. interviewing, factual investigation and development, preparing a litigation plan, pretrial motions, discovery, preparing witness examinations, and the use of experts, etc.]
