Section 504 as a Mechanism to Seek Redress
for Wrongful Civil Commitment

Bill Brooks, J.D.

This workshop examines how courts have treated attempts to use Section 504 of the Rehabilitation Act to challenge medical decisions and the impact of judicial decisions on attempts to use Section 504 to challenge the stereotyping of people subject to civil commitment. It will compare how courts have viewed Section 504 as a mechanism to challenge clinical decisions with how courts have treated Title II of the Americans with Disabilities Act, the statute for which Section 504 served as a model.
